Shipping containers have a wide range of applications, from storage, refrigeration, office and residential functions. The following question “can a storage facility be erected without an official permit?” is one of the most common questions during the first conversation with a potential customer.

Request to put up a container – what does the law say?

The answer to the above question is the interpretation of Article number 29 paragraph 1 item. 2 of the Construction Law (Journal of Laws of 2016, item 290, as amended).

Digging deeper into the law, two cases can be distinguished in terms of the potential placement of the purchased equipment. The first is when the customer wants to place the storage facility on his plot, the second possibility is to place the container on a commercial plot. Keep in mind that we are talking about packing houses or facilities whose total area does not exceed 35m2 (a 20-foot container is 14.5m2, a 40-foot container is 29m2).

Residential container for property plot

In the case of a proprietary plot, it is enough to notify the competent authority (usually the Starost) in writing of the desire to erect a container. It is important that there be no more than two such objects per 500 m2 of a given plot. The Starost’s Office, as the supervising authority, has 21 days to object to the submitted application, the lack of objection from the Authority is treated as “tacit consent.”

A 35m2 residential container – when does it need to be moved?

In the case of a commercial plot, we proceed in exactly the same way, except that after 180 days of notification, the warehouse must be removed or rearranged.
